Congratulations to David Mota. David was acquitted on all charges in the First Degree Felony Murder case brought against him by the Pima County Attorney's Office. On February 28, 2013, David stood his ground when he acted in self defense and caused the death of another motorist in a road rage situation turned deadly. But, it wasn't David's rage. David had signaled a lane change and believed he had enough room to maneuver between two cars. The car behind him sped up as if it was going to rear-end him. Then the car pulled to David's passenger side. The driver of the other car and his girlfriend screamed obscenities, racial slurs, called David a faggot and flipped him off. David being from the small mining town of San Manuel and only 20 years old at the time, panicked. He was scared and felt threatened by this attack. He felt the other driver was going to do something irrational and shoot at him and his passenger. In the face of this tirade, David grabbed the .45 from under his seat and shot two warning shots out his passenger window striking his own passenger side mirror. He had no intention of harming the occupants of the other vehicle but, wanted to scare them so they would leave him alone. Both shots struck the driver's door of the other vehicle. One shot went through and hit the driver in the back below his left shoulder. The shot was fatal. David had no idea that he had shot anyone and turned left on Pusch View Lane. In fact, David believed the other car had turned to follow them. A short time later David was pulled over by the Oro Valley Police Department. He gave a full statement, honestly and truthfully relating the events of the incident. He was charged with Drive by Shooting and First Degree Felony Murder for the death of the driver and Aggravated Assault for the driver's girlfriend. Trial started on March 18th, 2014, and the case was given to the 12 person jury composed of 7 men and 5 women on March 25th at the end of the day. The jury began deliberations on March 26th and after approximately 4 hours the jury returned a Not Guilty verdict on all counts including the lesser included offense of Disorderly Conduct. It was truly a good day for the defense and further proof that our criminal justice system does work.

Curiously, there was nothing "negligent" about the killing of that man. However, often times jurors will negotiate with each other and settle on a verdict they all can live with. No doubt, that is what happened here. The issues are currently on appeal in the Arizona higher courts.
